Service Agreement (Terms of Service)

This document serves as a public offer (Service Agreement) between the Client and NorthWest Sky Video Production (the “Service Provider”). By confirming a booking or receiving services, the Client agrees to the terms below.

1. Scope of Work

The Service Provider offers professional aerial and ground photo/video services, including but not limited to real estate, business, landscape, and personal projects. The scope, duration, location, and deliverables will be discussed and agreed upon individually for each project.

2. Scheduling & Weather Conditions

Flight operations depend on weather, airspace restrictions, and FAA regulations. The Service Provider reserves the right to reschedule or cancel drone flights if conditions are unsafe or non-compliant with FAA Part 107. In such cases, the shoot may be rescheduled at no additional charge.

3. Client Responsibilities

The Client agrees to provide accurate details regarding location, timing, and access. If shooting requires special permits, permissions, or clearances, the Client is responsible for securing them in advance unless otherwise agreed.

4. Delivery & File Access

All final media (photos and videos) will be delivered via Google Drive within the agreed timeline. Files will remain available for download for 14 days after delivery. After this period, the Service Provider may remove the files from storage.

5. Payment Terms

Payment terms and amounts will be agreed upon prior to the project. A deposit or full payment may be required to confirm the booking. Invoices will be sent via email or shared payment link.

6. Revisions

Minor revisions (e.g., trimming, music changes, simple text corrections) are included within 5 business days after delivery. Significant changes or reshoots may be subject to additional fees.

7. Cancellations & Refunds

If the Client cancels the project less than 48 hours before the scheduled shoot, a cancellation fee may apply. If the Service Provider cancels for any reason, a full refund will be issued for any paid amount, or the shoot will be rescheduled.

8. Liability

The Service Provider will take reasonable precautions to ensure safety and quality. However, the Service Provider is not liable for delays or losses caused by weather, access restrictions, airspace limitations, or unforeseen technical issues.

9. Usage Rights & Licensing

• All photographs and video footage remain the intellectual property of NorthWest Sky Video Production.

• The Client is granted a non-exclusive, non-transferable license to use the final media for commercial and promotional purposes related to their business.

• The Client may not resell, sublicense, or share the media with third parties without written consent. Altering the original files is allowed only with approval, excluding simple adjustments for social platforms.

• The Service Provider retains the right to use the media for promotional purposes — including but not limited to website, portfolio, social media, and advertising.

• If the Client requires exclusive rights or wishes to restrict promotional use, this must be agreed upon in writing, and additional fees may apply.

10. Taxes and Exemptions

All prices listed do not include applicable taxes (including but not limited to sales tax). If the Client is purchasing on behalf of a business and claims exemption from sales tax, a valid exemption certificate (such as a resale certificate) must be provided prior to payment. Without such documentation, applicable taxes will be added in accordance with legal requirements.
